PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus, to call for the records relating to the impugned order of the 2nd respondent in Na.Ka.No.538/2009/B dated 19.03.2009 and quash the same and direct the respondents to regularise the period of leave from 27.10.2004 to 12.07.2005, that is, 259 days as unearned leave on medical certificate with pay and settle petitioner's retirement benefits with interest on belated payment of the retirement benefits.

With the consent of both the parties, this Writ Petition is taken up for final disposal.

2.The petitioner is aggrieved against the order of the 2nd respondent, whereby 259 days leave was treated as unearned leave. Pending Writ Petition, the leave of 259 days came to be regularised and treated as leave with pay through proceedings of the 2nd respondent dated 04.09.2019 and consequently the petitioner was paid a sum of Rs.1,31,628/- on 03.08.2021. The petitioner's pension was also revised accordingly. As such the grievance of the petitioner has been met and hence, no effective orders can be passed in the Writ Petition.
