This writ petition has been filed under Article 226 of Constitution of India, to issue a writ of Mandamus, directing the respondents to consider the representation dated 15.10.2025 and 05.11.2025 and sanction and disburse family pension in respect of Late K. Kasirajan, retired P.G. Assistant, Val Vil Ori GTR Higher Secondary school, Valavantahinadu, Namakkal District, bearing PPO No. R1629188, from the date of his death I.e 19.03.2024 within a time frame fixed by this Honble Court.

ORDER

The legal heirs of the deceased have approached this Court seeking family pension.

2. It is the case of the petitioner that her father was serving as Post Graduate Teacher (Physics) in the Adi-Dravidar and Tribal Welfare Department from the year 1991 and he retired from service on 31.05.2017 on attaining the age of superannuation. The petitioner has fairly accepted that her father suffered a minor punishment for stoppage of increment for three months without cumulative effect. It is also stated in the affidavit that the petitioner's father filed a writ petition before this Court seeking for a direction to the respondents to disburse his retirement and terminal benefits. According to the petitioner, during pendency of the one such writ petition, pension was sanctioned to her father and he was also receiving the same. The petitioner has averred that no interest was paid for the delayed payment of pension.

The petitioner's father passed away on 19.03.2024 and his mother pre-deceased him on 04.05.202012. The petitioner, her sister and brother are the surviving legal heirs of their deceased father. The petitioner has averred in the petitioner that legal heir certificate has been issued to them by the Tahsildar, Chinnasalem on 18.10.2024. Though the petitioner made a representation to the respondents for grant of family pension, but, till date, no action has been taken and that the petitioner and her siblings are suffering untold hardships due to financial crisis.

3. Heard both sides and perused the materials available on record.

4. The learned counsel for the respondents do not dispute the legal heirship certificate issued to the petitioner and her siblings.

5. Without going into the merits of the claim made by the petitioner, the petitioner and her siblings are directed to appear before the third respondent within a period of four weeks from the date of receipt of a copy of this order and submit an application for claiming family pension. In case any such representation is made by the petitioner and her siblings, the third respondent shall pass an order within a period of six weeks thereafter.
