respondents herein to peacefully retire the petitioner from service on attaining the age of superannuation i.e., on 30.09.2009 with all consequential retirement benefits.

O R D E R

This writ petition has been filed seeking the following prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus calling for the records of the first respondent in connection with the impugned orders issued by him in [i] Charge Memo in Lr.No.3893/G1/98, dated 28.05.1998 [ii] G.O.Ms.No.122, Handlooms, Handicrafts, Textiles & Khadi (G.1) Department, dated 25.09.2009 and [iii] G.O.Ms.No.123, Handlooms, Handicrafts, Textiles & Khadi (G.1) Department, dated 30.09.2009 and quash the same and direct the respondents herein to peacefully retire the petitioner from service on attaining the age of superannuation i.e., on 30.09.2009 with all consequential retirement benefits.

The 2nd respondent filed compliance affidavit stating that the relief that is sought by the petitioner is already granted by the respondents. The relevant paragraph from the compliance affidavit filed by the

respondents reads as under:

"3. It is submitted that, the petitioner has filed this writ petition praying to issue orders quashing

1) The charge memo in ltr.No.3893/G1/98, dated 28.05.1998.

2) G.O.Ms.No.122, Handlooms, Handicrafts, Textiles & Khadi (G1) Department, Dt.: 25.09.2009 and

3) The G.O.ms.No.123, Handlooms, Handicrafts, Textiles & Khadi (G1) Department, Dated: 30.09.2009 and direct the respondents herein to peacefully retire the petitioner from service on attaining the age of superannuation i.e., on 30.09.2009 with all consequential retirement benefits.

It is submitted that, the petitioner's prayer stands fulfilled as disciplinary action on the charges in memo in letter no.3893/G1/98, Dt.: 28.05.1998 initiated by the 1st respondent has been dropped in the G.O.(Ms).No.26, Handlooms, Handicrafts, Textiles and Khadi (G1) Dept., Dated: 20.02.2014. And the suspension of the petitioner ordered vide G.O.(Ms) No.122, HHT&K (G1) Dept., Dt.: 25.09.2009, has also been revoked and he petitioner has been permitted to retire from service on the date of his superannuation on 30.09.2009.

After Noon in G.O.(Ms).No.27, Handlooms, Handicrafts, Textiles and Khadi (G1) Department dated 20.02.2014 and G.O.(Ms.) No.28, HHT&K (G1) Department Dated : 20.02.2014 respectively.

Therefore, Since the entire prayer of the petitioner in W.P.No.17483/2010 stands fulfilled now, nothing remains there in the writ petition to be considered by this Hon'ble Court."

In the light of the above, the cause in the writ petition does not

survive and the same is accordingly dismissed as having become infructuous. Connected miscellaneous petitions, if any, shall stand closed.
