O.A.No.70 of 2024 and A.No.588 of 2024 in C.S. (Comm. Div.) No.20 of 2024 ABDUL QUDDHOSE.J., No useful purpose will be served if O.A.No.70 of 2024 and A.No.588 of 2024 are allowed to be kept pending. The applicant / plaintiff was not granted an exparte order in the said application by this Court. The first and second defendants' right to file the written statement has already been forfeited. Since the third defendant has to file his written statement / counter that too when O.A.No.70 of 2024 and A.No.588 of 2024 have been kept pending from the date of inception of the suit, necessarily no useful purpose will be served by keeping the said applications pending.

Accordingly, O.A.No.70 of 2024 and A.No.588 of 2024 are closed by directing the parties to go for Trial.
