O R D E R
This Writ Petition is filed to direct the respondents to consider the representation dated 03.10.2024 and consequently direct the 1st and 2nd respondents to disburse the stipend for the period where the petitioner worked as a Training Intern from 11.10.2019 to 10.10.2020 at Coimbatore Medical College.
2.The petitioner got admission for pursuing MBBS Course through Government quota based on the petitioner's merit in Karpaga Vinayaga Institute of Medical Science & Research Centre, GST Road, Chinnakolambakkam, Palayanoor Po., Maduranthagam - 603 308 for the academic year 2014-15. The petitioner already filed a Writ Petition in W.P.NO.17612 of 2015, for transferring the petitioner from Karpaga Vinayaga Institute of Medical Science & Research Centre, GST Road, 2/7
Chinnakolambakkam, Palayanoor Po., Maduranthagam - 603 308. During the pendency of the writ petition, the petitioner filed an application on 10.09.2015, seeking for migration. It was brought to the notice of the petitioner that Clause 6(c) of the prospectus for the admission to MBBS/BDS courses 2015-16 prohibited migration for the students who got admitted for the previous year for being considered for the next year. Hence the petitioner filed an application to amend the prayer and challenged the above said clause. This Court vide order dated 18.092015, allowed the writ petition and further directed the 1st respondent and the Selection Committee, Directorate of Medical Education to accommodate the petitioner and other similarly placed persons either at Stanley Medical College, Chennai or at Coimbatore Medical College.
Aggrieved by the order passed by this Court on 18.09.2015, the 1st respondent and the Selection Committee, Directorate of Medical Education preferred a Writ Appeal in W.A.Nos.112 & 113 of 2016 and the same were dismissed by this Court vide Judgment dated 23.02.2016. Thereafter the first respondent issued G.O.(D).No.651, Health and Family Welfare (ME) Department, dated 17.05.2016, granting permission for transfer of the petitioner from Karpaga Vinayaga Institute of Medical Science & Research Centre, GST Road, Chinnakolambakkam, Palayanoor Po.
Maduranthagam - 603 308 to Coimbatore Medical College, Coimbatore. The second respondent vide proceedings dated 19.05.2016 in Proc.No.369/SCS l
(2) /2016 transferred the petitioner to Coimbatore Medical College, Coimbatore. Thereafter the petitioner joined Coimbatore Medical College, Coimbatore - 14, by obtaining relieving order from Karpaga Vinayaga Institute of Medical Science & Research Centre. While studying at Coimbatore Medical College, the petitioner underwent Internship Training for a period of one year from 11.10.2019 to 10.10.2020. The petitioner was also issued intership completion certificate by the third respondent vide Certificate of Compulsory Rotatory Resident Internship dated 11.11.2020. Thereafter the third respondent vide letter dated 03.10.2022, directed the second respondent to consider the claim of the petitioner for stipend for the period of her intership. The petitioner sent a representation dated 03.10.2024 to the 1st and 2nd respondent for disbursement of the stipend amount for the period she worked as a Training Intern at Coimbatore Medical College and as the same was not considered the petitioner filed the above writ petition for the aforesaid relief.
3.Considering the limited scope of the prayer sought for in the writ 4/7
petition, a direction is issued to the second respondent to consider the representation dated 03.10.2024, and pass orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
4.Accordingly, this Writ Petition stands disposed of. However, there shall be no order as to costs.
