FORT ST.GEORGE, CHENNAI-9 2 THE ENGINEER IN CHIEF (WRO) AND CHIEF ENGINEER (GENERAL), PUBLIC WORKS DEPARTMENT, CHEPAUK, CHENNAI-5 Petitions praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to (i)pass an order of ad interim injunction restraining the respondents from making any promotion to the post of Assistant in the public works Dept. based on G.O.(3D) No.50 PWD dated 12.8.2004 under one unit scheme (in WPMP.No.14484/2006)and (ii)to vacate the interim injunction ordered by the Honourable High Court in WPMP.No.14484 of 2006 in WP.No.12893 of 2006 dated 28.4.2006(in WVMP.No.381/2007)pending disposal of the above WP.No.12893/2006.
Order : These petitions coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MS.DURGA, for M/S.A.V.BHARATHI Advocate for the 1 & 2 PETITIONERS IN WPMP.14484/2006 AND 1 & 2 RESPONDENTS IN WVMP.381/2007 and of MR.C.SELVARAJ, on behalf of the 1 & 2 RESPONDENTS IN WPMP.14484/2006 AND 1 & 2 PETITIONERS IN WVMP.381/2007 the court made the following order:-
Ms.Durga and Mr.C.Selvaraj, learned counsel on either side are before this Virtual Court.
2. Read this in conjunction with and in continuation of separate proceedings made in main writ petition today which reads as follows: 'Ms.Durga, learned counsel representing the counsel on record for writ petitioners and Mr.C.Selvaraj, learned State counsel for both respondents are before this Virtual Court.
2. Learned counsel on both sides request for adjournment stating that time is required for them to prepare for advancing final hearing arguments if it becomes necessary.
3. As both learned counsel submit that it is also necessary to ascertain current position i.e., to ascertain if anything survives in the matter, request for time to ascertain and request acceded to.
4. List a fortnight hence. List on 25.08.2021.'
3. The above will demonstrate that the main writ petition being heard out and being disposed of is in the anvil. Therefore, no useful purpose would be served by keeping the captioned miscellaneous petitions pending at this distant point of time i.e., considering that the main writ petition itself is of the year 2006.
4.
