Petition praying that in the circumstances stated therein the High Court will be pleased to direct the VIII Additional Principal Special Judge for CBI cases, Chennai in return the petitioners passport bearing NO.P.3675229 so as to enable the petitioner to renew the validity of the same and to re-submit the same back to the Trial Court after renewal and pass such further or other orders or orders. [crl.op.no.20487/2017] Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of MR.RAMAKRISHNAN FOR M/S.WARAON AND SAI RAMS Advocate for the petitioner and of MR.K.SRINIVASAN SPECIAL PUBLIC PROSECUTOR FOR CBI CASES on behalf of the Respondent the court made the following order:- This petition is filed praying to direct the VIII Additional Principal Special Judge for CBI Cases, Chennai to return the petitioner's passport bearing No.P3675229 so as to enable the petitioner to renew the validity of the same and to re-submit the same back to the trial Court, after renewal.
2. Heard learned counsel appearing for the petitioner and the learned Special Public Prosecutor for CBI cases.
3. Report from the trial Court indicates that the case in C.C.No.64 of 2001 is adjourned to 20.10.2017 for framing charges.
4. However, it is now submitted by the learned counsel appearing for the petitioner that due to some interlocutory application filed by some other accused, the trial Court is not able to frame charges.
5.Taking note of the facts as stated in the affidavit filed in support of this petition, this petition is allowed on condition that the petitioner shall receive the passport bearing No.P3675229 from the trial Court viz., VIII Additional Principal Special Judge for CBI Cases, Chennai, on affidavit with an undertaking that immediately after renewal of his passport, he shall submit the same to the trial Court.
