Respondents PRAYER:- Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records relating to the order in Letter No.Personnel(1)-2/70200/2002 dated 18.08.2003 passed by the 2nd respondent and the consequential order passed by the 3rd respondent in Ref.NFC/Est.I/2734/EMS/2003 dated 18.10.2003, quash the same and consequently, direct the 2nd respondent to bear the pro-rata liability towards pension for the service rendered by the petitioner with the 2nd respondent from 19.10.1970 to 27.01.1978 and direct the third respondent to pay

the petitioner the pensionary benefits by counting his service with the 2nd respondent, award costs.

Ms.V.Porkodi, learned counsel representing the counsel on record for writ petitioner submits that the sole writ petitioner is no more and his legal heir is not interested in pursuing or prosecuting the matter any further. 2. In the light of the narrative thus far, captioned writ petition is disposed of as closed, having become infructuous. There shall be no order as to costs.
