Petition filed under Section 482 of Cr.P.C., to call for the records relating to the CC.No.49 of 2018 on the file of the learned Judicial Magistrate-II, Chengalpattu and quash the same.

The petitioners have filed this petition seeking to call for the records and to quash the proceedings in CC.No.49 of 2018 on the file of the leaned Judicial Magistrate-II, Chengalpattu. https://hcservices.ecourts.gov.in/hcservices/

2. The learned counsel for the petitioners submitted that without going into the merits of the case, this Court may permit the petitioners to file a discharge petition under Section 245 of Cr.P.C. before the Court below and fix a time limit to dispose of the said discharge petition.

3. The learned counsel for the respondent has also no objection for the relief sought for by the petitioners.

4. In view of the above, this Court directs the petitioners to file a appropriate discharge petition before the trial Court. If any petition is filed before the trial Court, the learned Magistrate shall dispose of the same within a period of three months from the date of receipt of a copy of this order. 5.With the above directions, this criminal original petition is disposed of. Consequently, connected miscellaneous petition is closed.
