Prayer in W.P.No.4015/2008 : Writ Petition under Article 226 of the Constitution of India praying for a Writ of Mandamus to direct the respondents to pay the petitioner pension every month. Prayer in W.P.No.47511/2006 : Writ Petition under Article 226 of the Constitution of India praying for a Writ of Certiorarified Mandamus calling for the records proceedings of the First Respondent in Lr.No. 3912/Pension-I/TNSTC (Salem Div-I)/2002~8 dt. 27.09.2002 and quash the same and further direct the Respondents to pay the Petitioner Pension every month.

Mr.D.Raghu Standing Counsel C O M M O N O R D E R Since the prayer sought for in these writ petitions are similar and issue raised in all these writ petitions is one and the same, with the consent of the learned counsel for both sides, all the three writ petitions were heard together and are being disposed with this common order.

In all these writ petitions, the petitioners were the erstwhile employees of the respondent Transport Corporation and after having rendered long years of service, they retired from service on attaining superannuation.

However, after retirement, their pensionary benefits had not been disbursed. Therefore, in order to get the pension order and to disburse the pension payable to these petitioners, these writ petitions have been filed with the respective prayer.

On notice, the learned Standing Counsel entered appearance for the respondents and during the last hearing, the learned Standing Counsel submitted that, the prayer sought for in these writ petitions seeking pension had already been sanctioned and the sanction order issued in this regard would be filed during the next hearing date. That is how the matter has been adjourned to today.

Today when the cases are taken up for hearing, Mr.D.Raghu learned Standing Counsel for the respondents filed a separate typed set of papers in each of these writ petitions. The pension orders sanctioned to each of the petitioners have been filed. Accordingly, in respect of the first case, the pension order was passed on 05.07.2018 and in respect of the 2nd and 3rd cases, the pension orders were passed on 23.06.2018. A copy of the orders have also been given to the learned counsel for the petitioners. The learned counsel for the petitioners did not dispute passing of such orders and no contra instructions seems to have been received from the respective petitioners.

In that view of the matter, since the prayer sought for by the petitioners had already been accomplished in the year 2018 itself and the pension orders have been passed by the respondent Corporation, this Court feels that these writ petitions can be disposed of. Accordingly, these writ petitions are disposed of. No costs.
