Common Prayer: Writ Petition filed under 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents to de-seal the petitioner's premises situate at Door Nos.23/2, & 23/3 'F' Block, 9th Street, Anna Nagar East, Chennai - 600 102, based on petitioner's representation dated 09.01.2025 so as to enable her to remove her articles and carry out demolition work.
For Petitioners : Mr.V.Chandraprabu in both petitions For Respondents : Mr.D.B.R.Prabhu Standing Counsel C O M M O N O R D E R The premises belonging to the petitioners were locked and sealed as they had been put up without a sanction plan. After the locking and sealing that happened on 25.03.2023, the petitioner have applied for demolition and re-construction. They have also paid the fee for demolition. The demolition has also been sanctioned.
2. It is the plea of the petitioners that they could remove their belongings and demolish the building in question, if the lock and seal are removed. Now that a demolition plan is sanctioned, there will be a direction 2/5
to the Corporation to de-seal the premises and the petitioners shall remove their belongings and start demolition within a week from the date of desealing and complete the demolition within a period of eight weeks therefrom. If the building is not demolished within the period, it will be open to the Corporation to re-seal the premise without any further notice.
