O R D E R

This revision has been filed to set aside the order dated 03.12.2024 made in M.C.No.631 of 2015 on the file of the II Additional Principal Family Court, Chennai and allow this Criminal Revision Petition 2.The petitioner got married with the respondent on 1/4

25.06.2007. The petitioner /husband is working as a Manager in a Software company at EMC Corporation in Bangalore and he has been deputed his services to United States of America in the year 2014 thereby he is earning a sum of Rs.3,50,000/- per month. While being so, there was misunderstanding between them since they have no issues. The respondent was driven out her from the matrimonial home. Hence, the respondent filed a H.M.P.No. 3273 fof 2016 before the II Additional Principal Judge seeking for divorce filed by the petitioner/husband and the original petition for restitution of conjugal rights. The petition filed in H.M.P.No. 3273 fof 2016 seeking for divorce is allowed. The maintenance petition filed by the respondent/wife is allowed and ordered maintenance of Rs.50,000/- per month.

3. The learned counsel for the petitioner submitted the respondent is also a graduate and she was working before the marriage and thereafter she quit the job. If she wants to go for a job, she can very well go for a job. He further submitted that the respondent in her deposition admitted that she had received 3.8 lakhs from her husband's father towards the premium payment for a LIC policy.

4. On a perusal of records admittedly the petitioner is working as a 2/4

Manager in a Software company at EMC Corporation in Bangalore and the respondent is not working any where. Therefore, the respondent did not able to maintain herself and she filed a petition for maintenance in M.C.No.631 of 2015 before the II Additional Principal Family Court, Chennai and an order was passed directing the petitioner herein to pay a sum of Rs.50,000/- per month. Hence, this Court finds that there is no infirmity or illegality in the order passed by the trial Court.

7. In view of the above, this Criminal Revision petition is dismissed.
