Writ petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents 1 to 4 to consider the petitioner's representation dated 18.11.2017 and provide appointment to the petitioner as Village Assistant in the existing vacancies available in Vallam Union, Villupuram District. O R D E R

The Writ Petition has been filed seeking to issue a Writ of Mandamus, directing the respondents 1 to 4 to consider the petitioner's representation dated 18.11.2017 and provide appointment to the petitioner as Village Assistant in the existing vacancies available in Vallam Union, Villupuram District.

Learned Counsel for the petitioner submitted that the petitioner studied up to 12th Standard and also registered his qualification with the District Employment Officer, Villupuram in the year 2003. His father expired in the early part of his life. So, he could not pursue his higher studies. This apart, he married a girl who belongs to the Most Backward Class Community and also got two female children out of the said wedlock. He has approached the District Collector, Villupuram seeking priority in the matter of providing appointment to him commensurate with his educational qualification. Moreover, he has also taken part in some of the interviews held in the years 2013 and 2015, but, he was not declared eligible in those interviews. Hence the present Writ Petition. 3.

Heard the learned Counsel for the petitioner and the learned Government Advocate, who takes notice for respondents 1, 3 and 5 and the learned Additional Government Pleader, who takes notice for 2nd respondent.

At the outset, this Court is unable to entertain this writ petition seeking a direction to the respondents to consider the petitioner's representation dated 18.11.2017 and provide appointment to him as Village Assistant in the existing vacancies available in Vallam Union, Villupuram District on the ground that his marriage is an intercaste marriage and also belongs to a weaker section of the society. That apart, when the petitioner himself has averred in his affidavit that he had also taken part in some of the interviews during the year 2013 and 2015, he should try to improve upon his merit and continue to take part in the selection process going to be informed. Without doing so, the petitioner cannot approach this Court seeking a direction to the respondents for providing employment to him. Neither the District Collector nor this Court has got any such power to give employment to the petitioner.

In the result, the Writ Petition fails and the same is accordingly dismissed. No costs.
