2. When the matter is taken up for hearing today (08.09.2023), the learned counsel for the appellant reported that the appellant was died and he is unable to substitute the legal heirs in this matter. He also stated that there is no further instruction in this matter.

3. Recording the same, this Civil Miscellaneous Appeal stands dismissed as abated. No costs.
