Mr.Vineet Subramani (For R1 to R6) Mr.V.Prakash (Senior counsel) For Mr.Adrian D.Rozario (For R7 to R10) COMMON ORDER The applications in A.Nos.618 & 619 of 2025 have been filed to implead the applicant therein as a party plaintiffs in C.S.No.86 of 2022.

2. The application in A.No.366 of 2024 has been filed to pass an order

to transpose the applicants from Defendants D9 and D10 to plaintiffs in the above suit in C.S.No.86 of 2022 on the file of this Hon'ble Court.

3. A memo had been filed by the plaintiffs on 18.02.2025, seeking permission of this Court to withdraw the suit along with other applications in D.No.6143 of 2025.

4. The contents of the memo is extracted hereunder: "That We, 1) Dr.A.D.Seshadri, son of Ankaiah, aged about 72 years, residing at No.10/44, Reddy Street, Nagalapuram, Chitoor, Andhrapradesh - 517589, 2) Selvaraj, S/o.Aruldas, Christian, aged about 60 years, residing at No.7, Gopal Menon Street, Choolai, Chennai - 600 112, 3) S.Robert, S/o.Sundaraja, Nagalapuram, Chitoor, Andhrapradesh - 517 589, 4)Mrs.Elizabeth J Rani, D/o.John Wesley, No.10/60/3, VKM Street, Nagalapuram, Chittoor, Andhrapradesh - 517 589, 5) G.Nalan, S/o.Gopal, No.2/103A, Nagalapuram West, Chittoor, Andhrapradesh - 517589, 6) A.Vedaiah, S/o.Amavasaiah, No.12/264, Nagalapuram East, Chittoor, Andhrapradesh - 517589, had preferred the aforesaid Civil Suit seeking for a permanent injunction to appoint interim administrator to take over and manage the affairs of the 1st defendant, Church of South India, including to conduct the upcoming elections, and the aforesaid matter was settled

between the plaintiff and the defendant through mediation among us, hence the 1st to 6th plaintiffs may be permitted to withdraw the civil suit along with all the other applications pending before this Hon'ble Court without seeking any liberty for the purpose of filing any fresh suit in accordance to the same cause of the action as emanated between the present parties."

5. The instant suit had been instituted under Section 92 of C.P.C., for framing a scheme in respect of the first defendant along with other reliefs. The application in A.No.366 of 2024 had been filed by the defendants 9 and 10 to to transpose themselves as plaintiffs to the suit and the applications in A.Nos.618 & 619 of 2025 have been filed by the applicants to implead them as party plaintiff to the suit.

6. Leave had been granted by this Court under Section 92 of C.P.C. As the plaintiffs in the suit have envisaged their intention not to proceed with the suit, this Court find no impediment in ordering the present applications as prayed for.

7. Accordingly, the applications in A.Nos.618, 619 & 366 of 2025 in C.S.No.86 of 2022 stand ordered as prayed for. However, there shall be no

order as to costs.
