When the writ petitions came up for hearing on 07.02.2018, this Court ordered notice and also granted interim stay of recovery alone. Now, W.M.P.No.31509, 31512 and 31513 of 2019 have been filed by the respondents seeking to vacate the interim stay already granted by this Court.
2.Heard the learned counsels for both sides.
3.Since the challenge in the writ petitions is to the recovery proceedings initiated by the respondent Corporation, pending finalization of the writ petitions, the stay already granted by this Court cannot be vacated. Accordingly, interim stay already granted by this Court, vide order dated 07.02.2019, is made absolute and W.M.P.Nos.3291, 3293 and 3295 of 2019 are allowed. Consequently, vacate stay petitions in W.M.P.Nos.31509, 31512 and 31513 of 2019 are dismissed.
