ORDER
The petitioner has filed the above Writ Petition to issue a Writ of Certiorari to call for the records of the proceedings dated 24.09.2004 on the file of the respondent and to quash the same.
2. By the impugned order dated 24.09.2004, the respondent ordered to recover a total sum of Rs.5,02,058/- from the petitioner being the loss caused by him to the organization and a punishment of 3 years for stoppage of increment with cumulative effect. The suspension period is treated as leave to which he is eligible as on 28.08.2003 and the leave salary shall be adjusted against the total recovery of Rs.5,02,058/- and the balance amount to be recovered in 82 equal monthly installments from the petitioner's salary commencing from the month of October 2001 to July 2011.
3. Mr.V. Bhiman, learned counsel appearing for the petitioner submitted that at the time of filing the Writ Petition, the petitioner was 52 years and now he should be more than 67 years and attained the age of superannuation. Further, the impugned order for the recovery of amount and https://hcservices.ecourts.gov.in/hcservices/
also the recovery of balance amount by instalments commencing from the month of October 2001 to July 2011 had already came to an end. The learned counsel appearing for the petitioner also submitted that he has not received any instruction from the petitioner so far.
4. Since the petitioner had attained superannuation and that the period fixed for the impugned order had already come to an end, I do not find any reason to keep the Writ Petition pending. Accordingly, the Writ Petition is closed. No costs. Consequently, the connected Miscellaneous Petition is closed.
