Prayer: Writ Petition is filed under Article 226 to issue a Writ of 1/6

Certiorarified Mandamus to call for the records of letter dated 03.06.2015 on the file of the 3rd respondent authorities and quash the same and direct the 3rd respondent authorities to reinstate the petitioner with backwages from 03.06.2015.

O R D E R

In the above Writ Petition the challenge is to the termination of the petitioner from the post of Panchayat Secretary.

2. The 2nd respondent has filed a counter in which it is stated that the authority competent to appoint Village Panchayat Secretary is the District Collector, that too after calling for the list of suitable 2/6

candidates from the District Employment Office.

3. The petitioner has been appointed by the Panchayat President, his termination was also by the Panchayat President, however, the order of termination has been stayed by orders of this Court dated 19.06.2015. By reason of this the petitioner has been continuing as a Panchayat Secretary all these years.

4. In the light of the above, the Writ Petition is disposed of with a direction to the 1st respondent to issue show cause notice to the petitioner questioning his appointment and his continuance in service within a period of 4 weeks from the date of receipt of a copy of this order. The petitioner shall cooperate for a speedy disposal of the enquiry proceedings. Consequently, the connected miscellaneous petition is closed. No costs.
