ORDER
This writ petition has been filed for direction directing the first and second respondents to consider the representation submitted by the petitioner dated 29.11.2023, seeking cancellation of patta in favour of the third respondent in respect of the property house and ground measuring 838.75 Sq.ft comprised in Old Survey No.899, R.S.No.1244 (part), S.No.1244/16 Survey Field No.1244/1/16, Block No.26, situated at Door No.14, Thalayari Street, Royapettah, Chennai- 600 014.
2. There is no representation on behalf of the petitioner. Heard the learned Special Government Pleader for the first and second respondents and the learned counsel for the third respondent and perused the materials available on record.
3. Originally, the Settlement Officer had issued patta in favour of the third respondent in respect of the subject property. Subsequently, it was challenged and the patta was issued in favour of the private individual, such as the petitioner herein. Once again, it was challenged before the Commissioner of
Land Administration, Chepauk, Chennai and the patta was issued in favour of the private individuals. It was challenged before the Hon'ble Division Bench of this Court in W.A.Nos.660 of 2010 and 359 and 360 of 2013. By an order dated 08.11.2023, this Court, remitted the matter back to the Commissioner of Land Administration for fresh disposal and now, it is pending.
4. Now, the patta stands in the name of the third respondent. Therefore, the representation submitted by the petitioner for cancellation of patta cannot be considered at this stage, since already the matter is now pending before the Commissioner of Land Administration.
