2. The applicant is the defendant in the suit. The suit has been filed for infringement and passing off. The applicant's representative knows only Kannada language. He neither knows English nor Tamil. In such circumstances, A.No.536 of 2024 in C.S.No.427 of 2015 has been filed seeking for appointment of an advocate commissioner, who knows Kannada for the purpose of translating the questions put by the learned counsel for the plaintiff into Kannada and to record the applicant's representative's reply 1/3

from Kannada to English.

3. The learned counsel for the respondent / plaintiff has not raised any serious objection for allowing A.No.536 of 2024 in C.S.No.427 of 2015. This Court is also satisfied with the reasons stated in the affidavit filed in support of this application as sufficient cause has been shown. Accordingly, this Court appoints Mr.S.Vijayanand, MS.3490 / 2015 having Office address as No.49, Law Chambers, High Court Building, Chennai - 600 104, Ph. No.:9789353235, as advocate commissioner to translate the questions from English to Kannada and to record the applicant's representative's reply from Kannada to English and the application is allowed as prayed for. The applicants / defendants are directed to pay the advocate commissioner a remuneration of Rs.15,000/-.
