Vide order dated 26.08.2021 this Court had enlarged the petitioner on anticipatory bail on certain conditions. This petition has been filed by the petitioner seeking modification of the conditions.
2. Learned Government Advocate (Crl.Side) appearing for the respondents, on instruction, strongly opposed this petition, as the petitioner on his own volition only accepted to deposit the amount, while granting anticipatory bail.
3. As rightly pointed out by the learned Government Advocate (Crl.Side), while granting anticipatory bail, the petitioner on his own volition, came forward to deposit the amount. Now he could not get back from his stand and seek modification of the said condition.
4. In view of the above, the Criminal Miscellaneous Petition stands dismissed.
However, time is extended by four weeks to deposit the amount, failing which, the anticipatory bail granted by this Court in favour of the petitioner shall stand automatically vacated, without further reference to this Court. However, the other conditions stand unaltered.
