J U D G M E N T

During mentioning time, the learned Counsel for the Appellant seeks adjournment.

2. On perusal of the records, it is found repeatedly that the learned Counsel for the Appellant had sought adjournments with all the learned Single Judges who presided over this Roster.

3. The case is of the year 2018. Now we are in 2023.

4. The Appeal is filed against the acquittal by the victim.

5. From the records, it is found that the case was already filed in the year 2017, and the Registry had returned the case records seeking maintainability after the limitation period. Only after representation before the Court it was accepted on prima facie materials. Now the main case is coming up for Appeal.

6. Therefore, the learned Counsel for the Appellant is not ready to prosecute the Appeal.
