ORDER

Challenging the order passed by the second respondent in M.V. Taxation Appeal No.3 of 2019 dated 20.11.2019, the present Writ Petition has been filed.

2. Heard the learned counsel appearing on either side.

3. When the matter is taken up for hearing, the learned Additional Government Pleader, Puducherry, submitted that as against the order of the Appellate Authority, the petitioner can avail the effective remedy by way of filing a revision before the State Transport Appellate Tribunal as per Section 90 of the Motor Vehicles Act, 1988.

4. Considering the submissions made by the learned Additional Government Advocate (P) and since the provisions of Section 90 of the Motor Vehicles Act, empowers the State Transport Appellate Tribunal (STAT) to revise orders passed by the State Transport Authority (STA) or Regional Transport Authority (RTA), liberty is granted to the petitioner to avail the provision of revision before the State Transport Appellate Tribunal. If any such revision is filed by the petitioner in this regard, the State Transport Appellate Tribunal shall consider and pass appropriate orders in accordance with law by excluding the period, the matter pending before this Court for the purpose of limitation.

5. With the above observation and direction, this Writ Petition is disposed of. Consequently, connected Miscellaneous Petition is closed. There shall be no order as to costs.
