ORDER

This writ petition is filed challenging Para no.7(a) of G.O.Ms.No.110 Transport Department dated 06.06.2002, read with G.O.Ms.No.189 Transport ( R.W.1) Department dated 13.08.2004.

2. It is submitted by both the learned counsel for the petitioner as well as respondents that the issue stands resolved by the order of the Division Bench of this Court in Writ appeal No.1246 of 2009 dated 18.08.2010, in view of the same this writ petition stands disposed in terms of the order of this Court in W.A.No.1246 of 2009 dated 18.08.2010.

3. It is also submitted that subsequent to the orders of this Court G.O.Ms.No. 387 dated 10.12.2019 has also been issued.

4. The Respondents may consider the applicability of the G.O.Ms.no. 387 dated 10.12.2019 and decide any claim that may be lodged in terms thereof.

5. It is open to the petitioner to file any representation within a period of three weeks from the date of the receipt of a copy of this order and the respondents shall consider the same and pass orders within twelve weeks thereof in accordance with law. No costs. Consequently connected miscellaneous petition is closed.
