J U D G M E N T
Learned counsel for the appellants as well as the respondent made a submission that the Award dated 18.04.2016 passed in EC No.566 of 2012 was an ex parte Award. However, petition was filed to set aside the ex parte Award and the said petition was allowed by the Trial Court.
2. In view of the fact that the claim petition was restored on file for adjudication, the present Civil Miscellaneous Appeal deserves no further consideration and accordingly, CMA No.2556 of 2016 stands closed. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is also dismissed.
