(Crime No.9 of 2022) ..Respondent(s) Prayer: This Criminal Miscellaneous Petition is filed under Section 389 (1) of Cr.P.C., to relax the condition imposed on the petitioner in Crl.M.P.No. 19035/2025 in Crl.A.No. 1575/2025 dt. 12.11.2025 that he should appear before the respondent police on every Saturday at 10.30 a.m and also appear before the Trial Court on the first working day of every English Calendar month at 10.30 a.m for a period of 6 months.

ORDER

Vide order dated 12.11.2025 made in Crl.MP.No.19035 of 2025 in Crl.A.No.1575 of 2025, this Court had suspended the substantive sentence of imprisonment imposed on the petitioner and enlarged him on bail on certain conditions and one among such conditions is that the petitioner shall appear before the respondent police on every Saturday at 10.30 a.m. and also appear before the trial court on the first working day of every English calendar month at 10.30 a.m. for a period of 6 months. This criminal miscellaneous petition has been filed by the petitioner seeking relaxation of the aforesaid condition.

2. Learned Government Advocate (Crl. Side) appearing for the respondent submitted that the petitioner has been complying with the conditions imposed by this Court without any default.

3. In view of the above, this Court is inclined to modify the condition imposed by this Court in respect of the appearance of the petitioner in the following manner.

4. Accordingly, the condition insofar as the petitioner's appearance as imposed by this Court at para no.7(iii) of the order dated 12.11.2025 made in

Crl.MP.No.19035 of 2025 in Crl.A.No.1575 of 2025 alone stands modified to the effect that the petitioner shall appear before the trial Court on the first working day of every month at 10.30 a.m., until further orders. All other conditions imposed in the order dated 12.11.2025 remain unaltered.
