Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents to permit the petitioner to take assistance of the lawyer held into the chargememo dated 18.03.2024 as per Section 30 of the Advocates Act, 1961, since the entire proceedings has been initiated based on the FIR in Crime No.1 of 2022 dated 04.04.2022 lodged by the CBCID, Vellore. 1/4

By consent, the writ petition is taken up for final disposal at the admission stage itself.

2.The petitioner has filed this writ petition seeking direction to the respondents to permit the petitioner to take assistance of the lawyer as per Section 30 of the Advocates Act, 1961. 3.The learned counsel appearing for the petitioner submitted that the petitioner was working as the Deputy Manager Quality Control at Vellore Region and was transferred to Cuddalore Region and was thereafter transferred to Krishnagiri Region and was superannuated on 30.11.2024. Based on a complaint dated 04.04.2022 lodged by CBCID Vellore, a charge memo dated 18.04.2023 was issued against the petitioner. Since the proceedings was initiated based on the FIR in Crime No.1 of 2022 dated 04.04.2022 lodged by the CBCID - North, Vellore, for the offence under Sections 166, 167, 420, 120B of I.P.C., the petitioner made representation dated 19.01.2026 to the first 2/4

respondent for assistance of lawyer in the enquiry, however, there is no fruitful response.

4.Considering the limited relief sought for in this petition, this Court without expressing any opinion on the merits of the case, directs the Enquiry Officer to consider the petitioner's representation dated 19.01.2026 with regard to the assistance of lawyer for participating in the enquiry, in accordance with law.
