When the matter is taken up for hearing, learned counsel appearing for the petitioner would submit that since there has been a statutory appeal provision available, liberty may be given to the petitioner to file an appeal.

2.Finding no serious objection from the learned Special Government Pleader appearing for respondents 1 and 2 and the Additional Government Pleader appearing for the third respondent and accepting the request of the petitioner that the existence of the appeal remedy would bar the petitioner from invoking the writ jurisdiction, this Court, grants liberty to the petitioner to file an appeal against the impugned order within a period of three weeks from the date of receipt of a copy of this order. 3.With the above observation, the writ petition stands disposed of. Consequently, connected M.P. is closed. No costs.
