ORDER

This petition has been filed to direct the respondent police to take appropriate action on the complaint dated 19.10.2019 given by the petitioner.

2. The learned counsel for the petitioner has submitted that one Thirumurugan was working with the petitioner's company since 1999 and subsequently, when the firm was converted to a private limited company in the year 2010, the said Thirumurugan was appointed as the Director of the Company as well as CEO of the company in the year 2013 to look after the entire management. He further submitted that the said Thirumurugan has misappropriated the huge amount of the company and hence, a complaint was lodged before the respondent on 19.10.2019, but, so far, no action has been taken on the petitioner's complaint. 1/2 https://hcservices.ecourts.gov.in/hcservices/

3. The learned Additional Public Prosecutor (Pondicherry) has submitted that inspite of the requests made by the respondent, the petitioner has not produced the audit report and hence, the respondent is not able to proceed further on the petitioner's complaint.

4. The learned counsel for the petitioner by way of reply has submitted that so far the petitioner has not received any intimation from the respondent for producing the audit report.

5. Considering the aforesaid submissions, the respondent is directed to send summons to the petitioner to produce the said audit report and other documents if any required for investigation and inspite of the said summons, if the petitioner failed to produce the said documents, it is open to the petitioner to dispose of the complaint in accordance with law.

6. With the above directions, this Criminal Original Petition is disposed of.
