O R D E R

This writ petition has been filed for issue of writ of mandamus directing the respondents to act upon the application submitted by the petitioner wherein, the petitioner is seeking for survey and measurement of the property and for fixing the boundary stones.

2.Heard Ms.Subha Sangamithra, learned counsel appearing on behalf of the petitioner and Mr.P.Sathish, learned Additional Government Pleader appearing on behalf of the respondents.

3.The petitioner is claiming right over the subject property by virtue of a Gift Deed dated 19.04.2022 executed by her mother. The petitioner is also relying upon the patta that originally stood in the name of grandfather. The petitioner wanted a survey to be conducted for measuring the property and to fix the boundaries before applying for the patta. Hence, an application was submitted and this was not acted 2/4

upon. The same has resulted for the filing of the present writ petition. 4.Taking into consideration the facts and circumstances of the case and considering the limited relief sought for in this writ petition, there shall be a direction to the 2nd respondent to deal with the application submitted by the petitioner on 30.06.2023 and a survey shall be conducted by measuring the property in line with the title deed and the boundary stones shall be fixed. If there is any rival claim, the survey shall be conducted in their presence after giving notice. This process shall be completed, within a period of four weeks from the date of receipt of copy of this order.
