PRAYER : Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, to issue suitable direction or in the nature of direction, transferring the investigation pending on the file of the third respondent in Crime No.16 of 2021 to any other competent agency for the purpose of investigating the same according to law.

The first respondent is not necessary party. Hence his name is deleted.

2.This petition has been filed seeking for transfer of investigation pending on the file of the third respondent in Crime No.16 of 2021.

3.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

4. The grievance of the petitioner is that the accused persons had attacked him with deadly weapons and there was a clear attempt to commit murder. Inspite of the same, the 3rd respondent had registered the FIR only for an offence under Section 324 IPC. That apart, the petitioner alleges that there has been absolutely no progress in the investigation. 5.

Taking into consideration the facts and circumstances of the case, there shall be a direction to the Additional Superintendent of Police/Deputy Superintendent of Police, Mahabalipuram, to monitor the investigation conducted by the 3rd respondent. The 3rd respondent shall effectively conduct the investigation and file a final report as expeditiously as possible.

6. This Criminal Original Petition is disposed of with the above direction.
