Respondents Writ petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Certiorarified Mandamus, to call for the records of the impugned order passed by the 2nd respondent bearing No. E.1/ 3(3)/ 2017/RK/SLVC dated 21.03.2019 and quash the same and consequently direct the 2nd respondent to allow the petitioner to rejoin her service. O R D E R
(Order of the Court was delivered by D.KRISHNAKUMAR, J.) According to the learned counsel appearing for the petitioner, the first respondent passed the impugned order stating that the community certificate obtained by the petitioner is bogus and directed the second respondent to cancel the appointment order and terminate service of the petitioner. The said order is under challenge in the present writ petition.
2. The learned counsel appearing for the second respondent Corporation has submitted that the second respondent had passed an impugned order stating that the petitioner was removed from service. Challenging the said order, the petitioner has filed a writ petition in W.P.No.25598 of 2021 and this Court by order dated 28.11.2022 allowed the writ petition and directed the second respondent to reinstate the petitioner into service with all service benefits. Challenging the said order, the second respondent Corporation has preferred an appeal before the Hon'ble Supreme Court in SLP No.5799 of 2023 and the same is pending. Without disclosing the aforesaid fact, the petitioner has filed the instant writ petition before this Court. 2/4
3. Recording the aforesaid submission, nothing survives for adjudication of the writ petition and accordingly, the writ petition stands dismissed as infructuous No costs. Connected miscellaneous petition is closed.
