ORDER

(Order of the Court was made by S.M.Subramaniam J.) Contempt Petition has been instituted to punish the respondents for not implementing the orders of this Court dated 28.07.2025 in W.P.No.26869 of

2025.

2. This Court directed the revenue authorities to survey the land and remove encroachments, if any identified.

3. Learned Special Government Pleader would submit that in pursuance to the orders of this Court, Revenue Tahsildar, Chinnasalem initiated action and surveyed the land. During the course of survey, authorities found that disputed portion of the land has been in the name Nainaarpalayam House Building Society. Therefore, necessary proposals are submitted to District Collector to reclassify the land for the purpose of confirming the same as a common pathway for the usage of public at large. Since the said process would take some time, petitioner has to wait for the final orders to be passed by District Collector.

4. Pertinently, authorities have initiated action pursuant to the direction issued by this Court. In view of the fact that enforcement action have already been initiated, and necessary steps are taken to reclassify the land and to make necessary entries in the revenue records, this Court is of the considered view that there is no willful disobedience of the orders of this Court.
