The Writ Petition has been filed challenging the advertisement issued by the first respondent calling for the applications to the post of Deputy Director (Distance Education).

2.Learned counsel for the respondents had drawn me to the counter filed by the first respondent wherein, it had been specifically averred that the impugned notification not been proceeded with and by the decision of the Executive Council on 22.11.2013, it was resolved to issue a fresh notification. For better appreciation, the relevant paragraph is extracted hereunder: "I state that the interview for the post of Deputy Director (Distance Education) with reference to Advertisement. No.RC/15 dated 02.09.2011 was not scheduled and subsequently the Executive Council in its 117th meeting held on 22.11.2013 resolved to issue fresh notification as more than 2 years have passed in the case of Non teaching positions."

3.In view of the specific averment made in the lis that is sought to be adjudicated in this Writ Petition does not survive any more as the advertisement impugned has been withdrawn.

4.In fine, the Writ Petition is closed. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed. 22.11.2023 Index: Yes/No Speaking order: Yes/No pam 2/4
