Crl.O.P.No.5029 of 2016: Criminal Original Petition filed under Section 482 of Cr.P.C, to direct investigation into the said matter to the respondent police and file an alter FIR under Section 307 and 326 of IPC, including that of those offences already registered under the above FIR No.248 of 2015 by the respondent police.

Crl.O.P.No.5030 of 2016:Criminal Original Petition filed under Section 482 of Cr.P.C, to direct the respondent police to secure the accused persons named in the FIR No.248 of 2015, viz., Mrs.Sundari, wife of Mr. Kandasamy and N.Kandasamy, who have not been arrested in the above FIR No.248 of 2015 on the file of the respondent police and to proceed in accordance with law.

O R D E R

These petitions have been filed to direct the respondent police to consider the petitioner's representation dated 27.12.2014 to alter F.I.R under Section 307 and 326 of IPC and also to arrest the accused persons named in the F.I.R. 2.The learned Additional Public Prosecutor submitted that based on the petitioner's representation, enquiry has been conducted and report has been filed before the learned Judicial Magistrate, Alandur on 14.02.2017 as "further action dropped". https://hcservices.ecourts.gov.in/hcservices/

He further submitted that the petitioner also died.

3. In view of the above submission made by the learned Additional Public Prosecutor, nothing survives in these petitions. Accordingly, these Criminal Original Petitions are dismissed as infructuous. However, if any one aggrieved, liberty is granted to file a private complaint in respect of closure report.
