The petitioner apprehends arrest for the alleged offence under Section 4(1)(A) and 4(1)(C) of the Tamil Nadu Prohibition (Amendment) Act, 2024 in Crime No.10 of 2026, on the file of the respondent police seeks anticipatory bail.

The case of the prosecution is that on 14.01.2026 the petitioner was found to be in illegal possession of Honey Day Brandy - 30 bottles and Vorion brand - 8 bottles totally 38 bottles of liquor each containing 180 ml in a sack near his house for the purpose of selling to the public and a cash of Rs.600/- and on seeing the police, he ran away from the scene of occurrence and the said contraband and cash was seized by the respondent police. Hence the case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. He further submitted that he is ready to abide by any stringent condition that may be imposed by this Court and he is ready to co-operate for investigation. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution's case and upon instructions submitted that the petitioner is having three previous cases of similar in nature. Hence, she opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case; and taking note of the submission made by the learned Government Advocate (Crl.Side); the 2/4

nature of allegations levelled against the petitioner; and also the fact that three previous cases of similar in nature has been registered against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
