Being aggrieved against the allotment of the retail outlet to the third respondent, the present Writ Petition has been filed.

2. The grievance of the petitioner seems to be that the petitioner herein is a widow and that preference ought to have been given to her as priority over selection to the third respondent herein.
3. The clause 8 of the conditions in the tender advertisement dated 24.11.2003 reads that whenever other things are equal, unmarried women aged above 40 years and widows will be given priority over others in all women category. In the instant case, the petitioner herein had scored 53 marks, while the third respondent had scored 63 marks. When the marks of the petitioner and the third respondent are not equal, the question of priority will not arise.

Apparently, since the third respondent had scored marks over and above the petitioner herein, there is no infirmity in the allotment of retail outlet in favour the third respondent and hence, there are no merits in the Writ Petition.
