These Civil Miscellaneous Petitions are filed to condone the delay of 3170 days in filing the petition and to set aside the abatement caused due to the death of the sole appellant and to implead the proposed parties as appellants 2 to 4 viz., wife, son and daughter. The respondents were served by substituted service. Proof for substituted service filed and the service held to be sufficient. Today, when the matter was called, there is no representation on behalf of the respondents.

Having satisfied with the reasons assigned for the delay, C.M.P.No.3031 of 2019 is allowed and the delay of 3170 days for filing the appeal is hereby condoned.

C.M.P.Nos.3032 & 3033 of 2019 are also allowed. The Registry is directed to amend the cause title by impleading these petitioners as appellants 2, 3, 4 in the respective Second Appeals.

Post the matter after four weeks.
