ORDER

The petitioners, who were arrested and remanded to judicial custody on 14.10.2025 for the alleged offences punishable under Sections 331(4), 305(a) of BNS, 2023 in Crime No.340 of 2025, registered on the file of the respondent police, seek bail.

2. The allegation against the petitioners is that during night hours, they trespassed into the defacto complainant's house, and took away a cash of Rs.1,30,000/-. Subsequently, the petitioners were arrested, however, the stolen property was not recovered. Hence, the complaint was lodged and the petitioners were arrested.

3. The learned counsel appearing for the petitioners submitted that the petitioners were in judicial custody since 14.10.2025 and due to previous enmity, they have been falsely implicated in this case and that the petitioners were ready to co-operate with the investigation. Hence, he prays to grant bail to the petitioners.

4. The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that, so far, the property was not recovered; and that the first petitioner has 11 previous cases and the second petitioner has 7 previous cases and all are similar in nature, pending against them. Hence, he opposed to grant bail to the petitioners.

Considering the nature of the allegations, the fact that the property was not yet recovered and that the petitioners having previous cases similar in nature against them and if the petitioners are released on bail, at this stage, they will indulge in similar offences. Therefore, this Court is not inclined to grant bail to the petitioners.
