second respondent to register the judgment and decree in O.S.No.645 of 2006 dated 01.12.2008 within the time frame stipulated by this Court.

ORDER
Intending to register the decree in O.S.No.645 of 2008, the petitioner presented the same for registration before the registering officer. The request for registration was declined under impugned order dated 21.11.2025. Hence this writ petition.
2. Mr.P.Harish, learned Government Advocate, accepts notice for respondents 1 to 3. Mr.R.Sanjay, learned counsel, appears on behalf of the Executive Officer of the temple concerned. He submits that the temple is a necessary party and that the matter should not be proceeded with in the absence of the temple. Mr.Harish submits that a speaking order was issued under Section 71 of the Registration Act, 2008 and that an appeal lies therefrom.
3. In view of the submissions of Mr.R.Sanjay, the Executive Officer, Arulmighu Mariamman Temple, is suo motu impleaded as 2/4
the fourth respondent in the writ petition. Mr.R.Sanjay, learned counsel, accepts notice for the newly arrayed party.
4. On perusal of the impugned order, it is noticeable that it is evidently a speaking order issued after putting all parties concerned on notice. An appeal lies against such order under Section 72 of the Registration Act. Given that a rival claim has been made by the temple represented by the H.R. and C.E. Department, it is appropriate that the matter be adjudicated by the appellate authority under the statute. The impugned order is dated 21.11.2025 and the present writ petition has been filed on 20.01.2026, which is within the time limit for lodging an appeal. In those circumstances, if the petitioner were to file a statutory appeal within thirty days from the date of receipt of a copy of this order, the appellate authority is directed to receive and dispose of the same on merits without going into the question of limitation.
5. With the above observations, this writ petition is disposed of. Consequently, connected miscellaneous petitions are closed. There shall be no order as to costs.
