This petition is filed to condone the delay of 385 days in filing the above appeal.

2.Though notice has been served on the 1st respondent and his name is printed in the cause list, there is no representation for him either in person or through counsel.

3.Heard the learned counsel appearing for the petitioner as well as M/s.I.Malar, learned counsel who took notice for the 2nd respondent.

4.Being satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 385 days is condoned on payment of cost of Rs.500/- (Rupees Five Hundred only) to 'Samarpana', No.10, Subramani Nagar, Vinayagapuram, Near Retteri, Kolathur Post, Chennai-99, [Savings Bank Account No.10156284387, State Bank of India, Jawahar Nagar Branch, Chennai, IFSC Code SBIN000758, Contact person:

Mr.B.M.Sridhar, Mobile No.9282112830], within a period of one week from the date of receipt of a copy of this order, failing which, this petition shall stand dismissed automatically, without further reference to this Court. The petitioner is not entitled for any interest for the delay period.
