When the present Writ Petition is taken up for hearing, the learned counsel for the petitioner submitted that the issue involved in this petition is covered by the Division Bench Judgment of this Court reported in 2005 Writ Law Reporter 740 and hence seeks permission of this Court to dismiss the petition and she has also made an endorsement in the petition to that effect.

In view of the submission and endorsement made by the learned counsel for the petitioner that the matter is squarely covered by the Division Bench Judgment of this Court reported in 2005 WLR 940 [K.M.Vijayan, Senior Advocate etc., V.
