ORDER
The petitioner, who was arrested and remanded to judicial custody on 13.01.2026 for the alleged offence punishable under Section 123, 286 of BNSS, in Crime No.31 of 2026, on the file of the respondent police, seeks bail. 1/4
2.The allegation against the petitioner is that the petitioner was involved in possession and sale of 1.265 kgs of banned Tobacco Products in his petty shop. Hence, the complaint.
3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case, since he has got some previous cases. He further submitted that he is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner has four previous cases, similar in nature pending against him. He further submitted that the investigation is still pending. Hence, he opposed for grant of bail to the petitioner.
5. Considering the nature of the allegations, quantity involved and that the petitioner has four previous cases, similar in nature pending against him and that the investigation is still pending, this Court is not inclined to grant bail to the petitioner.
6. Accordingly, this Criminal Original Petition is dismissed. 03.02.2026 drl 2/4
