This writ petition has been filed to call for the records of the Central Information Commission proceedings relating to its order No.
CIC/DS/A/2009/00056 dated 21.06.2010 and quash the same.
2. This writ petition was filed in the year 2010. It seems that in spite of repeated notices being issued, the same has not been served on the respondent on the ground that the respondent is not in the said address.
3. The writ petition is filed as against the order of the Central Information Commission No.CIC/DS/A/2009/00056 dated 21.06.2010. The respondent was not granted further promotion and therefore he sought for information about his Annual Confidential Report for the year 2005-2008 and the same was ordered to be provided under the order impugned in the writ petition. Appeal was filed at the relevant point of time on the ground that the act is not applicable to the petitioner's company. However, it is now brought to the notice of this Court that after filing of the writ petition in the month of August 2010, the respondent was promoted as Administrative Officer with effect from 29.10.2010 and further promoted as Scale-II Officer on 04.09.2023. Therefore, original cause of action of the petitioner itself would not survive.
4. In that view of the matter that since the entire exercise has become
academic, this Court is not proceeding to decide the matter at this belated point of time and it is not necessary for the petitioner to comply with the order of the Central Information Commission.
5. With the above observation, this writ petition is disposed of. No costs. Consequently connected miscellaneous petition is also closed. 26.02.2024 Index : Yes/No Speaking order/Non-speaking order dpq
