Prayer : Writ Petition filed under Article 226 of the Constitution of India seeking a Writ of Mandamus, directing the first respondent to consider the petitioner's representation, dated 29.10.2024 requesting to cancel the patta issued in favour of Mr.Srinivasan, Mr.Kanniappan and Mr.Jeyavelu and to issue patta in his name in respect of lands comprised in S.No.880/4A3, and 880/4A2 Thirumullaivoyal Village, Avadi Taluk, Thiruvallur District and to take action against the erred officials.

ORDER

This Writ Petition is filed to direct the third respondent to cancel the patta standing in the name of the respondent Nos.6 to 9 for the property more fully disclosed in the prayer to this Writ Petition based on the petitioner's representation, dated 29.10.2024 within a time frame to be fixed by this Court.

2. Mr.D.Ravichander, learned Special Government Pleader accepts notice on behalf of the respondent Nos.1 to 3 and 5. 2/6

Mr.V.Meganathan, learned Government Advocate (Crl. Side) accepts notice for the fourth respondent. Since no adverse orders are passed against the respondent Nos.6 to 9, notice to the respondent Nos.6 to 9 is dispensed with by this Court.

As seen from the documents filed along with this Writ Petition, it is known as to whether proceedings were initiated by the third respondent based on the petitioner's representation, dated 29.10.2024. In view of the same, necessarily, the petitioner will have to submit a fresh representation since the earlier representation, said to have been made by the petitioner, is dated 29.10.2024, which is an old one.

No prejudice will be caused to the respondents if the petitioner is permitted to submit a fresh representation seeking for cancellation of the patta standing in the name of the respondent Nos.6 to 9 and a direction is issued to the third respondent to consider the said representation on merits and in accordance with law after hearing the objections of the respondent Nos.6 to 9 and any other third party whom the third respondent deem fit to enquire, within a time frame to be fixed by this Court. This Court is not expressing any opinion on the merits of the petitioner's representation, 3/6

For the foregoing reasons, this Writ Petition is disposed of by directing the petitioner to submit a fresh representation to the third respondent seeking for cancellation of the patta standing in the name of the respondent Nos.6 to 9 for the property more fully disclosed in the prayer to this Writ Petition, within a period of two weeks from the date of receipt of a copy of this order. On receipt of the said representation within the stipulated time along with the supporting documents, the third respondent shall pass final orders on merits and in accordance with law on the said representation after hearing the objections of the respondent Nos.6 to 9 and any other third party whom the third respondent deem fit to enquire within a period of 12 weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
