Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the respondents to appoint the petitioner in any post or in Nutrition Meals Programme Department in Katpadi Block or any other Block in Vellore District as per Section 33 of Persons with Disabilities (Protection and equal Participation) Act 2005. ORDER

The writ petition is filed praying for a writ of mandamus to direct the respondents to appoint the petitioner in any post or in Nutrition Meals Programme Department in Katpadi Block or any other block in Vellore District as per Section 33 of Persons with Disabilities (Protection and equal Participation) Act 2005.

2. The learned counsel appearing on behalf of the petitioner submits that she is handicapped and her disability code is No.LD 27144, the nature of disability is LD 50%. She has passed Secondary School Leaving Certificate (SSLC) in the year 2005. On completion of SSLC, she had registered for employment with the Employment Exchange in Vellore District on 24.06.2009 with a Registration number W/12195/09, Division No.X0110. Thereafter, the petitioner submits that she had approached the respondents on numerous occasions requesting them to provide an opportunity in the Reservation category. proper response forthcoming from the respondents.

3. It is further submitted that the respondents are not complying with the mandate contained in Section 33 of the Persons with Disabilities (Protection and equal Participation) Act 2005. A representation was sent to the 1st respondent on 05.04.2010 and the same is stated to be still pending. However, during the course of the hearing, it was submitted by the learned counsel appearing on behalf of the petitioner that a direction may be given to consider the representation of the petitioner dated 05.04.2010 and to pass orders thereon in accordance with law.

4. Mr.Balathandayutham, Special Government Pleader appearing on behalf of the respondents does not have any serious objection to the said prayer. In view of the same, the respondents are directed to dispose of the representation of the petitioner dated 05.04.2010 in accordance with law as expeditiously as possible.
