The present petition has been filed to modify the condition imposed on the petitioner in Paragraph No.8 of the order dated 01.12.2022 passed by this Court in Crl.O.P.No.29292 of 2022 while granting anticipatory bail.

The learned counsel for the petitioner has submitted that the condition imposed on the petitioner is that the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties, out of which, one surety should be a local surety and one surety should be a blood surety, each for a likesum to the satisfaction of the learned Special Court under EC and NDPS Act Cases, Salem. He further submitted that the petitioner is in a very poor condition and not able to mobilize the amount, due to which, she was not able to comply with the conditions as imposed by this Court . Hence, he seeks modification.

3. Heard the learned Government Advocate (Crl. Side) appearing for the respondent police.

Taking into consideration, the facts and the submissions made by the learned counsel for the petitioner, this petition is allowed by modifying the condition to the effect that the petitioner shall execute a bond for a sum of Rs.10,000/- [Rupees Ten thousand only[ with two local sureties along with Aadhaar Card before the learned Judicial Magistrate-II, Salem, within a period of two weeks from the date of receipt of a copy of this order.

5. Except the above modification , all other conditions imposed by this Court in its order dated 01.12.2022 in Crl.OP.No.29292 of 2022 shall stand unaltered.

6. With the above modification, this Criminal Miscellaneous Petition is allowed.
