Prayer: Writ Petition is filed under Article 226 of the Constitution of India, seeking issuance of a writ of certiorarified mandamus, to call for the records pertaining to the order passed by the 3rd respondent in his letter / order dated 20.9.2004 and quash the same and direct the respondent to disburse the entire retirement benefits forthwith. O R D E R

The prayer made in this writ petition is to issue a writ of certiorarified mandamus to quash the letter/ order dated 20.09.2004 passed by the third respondent and consequently, to direct the respondents to disburse the entire retirement benefits forthwith to the petitioner.

2. There is no representation for the petitioner.

3. Today, when the matter is taken up for hearing, the learned Government Advocate for the respondents submitted that the petitioner died in the year 2015 and no steps have been taken to bring the legal heirs on record to pursue this writ petition. He has further submitted that the entire retirement benefits have been extended to the petitioner in the year 2005 itself. Hence, the prayer sought for in this writ petition has become infructuous.

4. Recoding the above submissions made by the learned Government Advocate, nothing survives for adjudication in this writ petition. Accordingly, the writ petition is dismissed as infructuous.
