ORDER

This Writ Petition has been filed challenging the impugned proceedings of the 1st respondent in Na.Ka.6023/2021/A4.

2.Heard Mr.R.Nalliyappan, the learned counsel appearing on behalf of the petitioner and Mr.A.Selvendran, the learned Special Government Pleader appearing for the respondents.

3.The main grievance that has been expressed by the petitioner is that the 2nd respondent has absolutely no right over the subject property and inspite of the same, a suit was filed in O.S.No.138 of 2006 before the District Munsif Court, Perundurai against the vendors of the petitioner. That apart, an application was also submitted for cancellation of the patta. The suit was dismissed by judgment and decree dated 15.07.2022. However, the 1st respondent issued the impugned notice by initiating proceedings. The petitioner has submitted detailed written objections as early as on 19.09.2024 and inspite of the same, the 1st respondent is calling the parties for enquiry and is not deciding on the proceedings which is pending from the year 2021. It is under these circumstances, the present writ petition came to be filed before this Court. 2/4

4.In the considered view of this Court, there is no need for interfering with the notice that was issued in the year 2021 at this stage. The petitioner has already submitted the objections and hence it will suffice if a direction is given to the 1st respondent to pass final orders in the pending proceedings within a period of four (4) weeks from the date of receipt of a copy of this order. 5.This writ petition is disposed of in the above terms. No costs. Consequently, the connected miscellaneous petitions are closed. 04.02.2025 Index : Yes / No kas To.
