BY [ RESPONDENT/COMPLAINANT ] THE INSPECTOR OF POLICE, ATTUR POLICE STATION SALEM DISTRICT.

(CRIME NO.1016/2014) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to relax the condition of appearing before the learned Judicial Magistrate No. I, Attur on the first working day of every Month at 10.30 till disposal of the Revision petition in Crl.M.P.No. 14892/2017 and thus render justice.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.SANJAY RAMASWAMI, Advocate for the petitioner and of M/S.A.DAMODARAN, Additional Public Prosecutor on behalf of the Respondent the court made the following order:- It is seen that Crl.R.C.No.1495 of 2017 was admitted and the petitioner was granted suspension of sentence by order dated 04.12.2017. The petitioner is convicted for the offences under Sections 279 and 304 (A) of IPC.

2.The grievance of the petitioner is that from the date of granting bail to the petitioner, the petitioner has been appearing before the trial Court on the first working day of every month without fail except on the day when the Court was closed due to Covid Pandemic. The petitioner is the resident of Chennai and the petitioner

is directed to appear before the trial Court viz., the Judicial Magistrate, No.I. Attur and he finds it difficult to appear on the first working day of every month since he has to take care of his aged mother.

3.The learned counsel for the petitioner submitted that he is ready for final hearing.

4.The learned Additional Public Prosecutor also represented that he is ready to argue the matter and the matter to be posted the matter for final hearing.

5. In view of the same, the criminal miscellaneous petition is dismissed.
